1. Acceptance of Terms

By accessing or using souldust.xyz ("Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. We may update these terms at any time; continued use constitutes acceptance of changes.

2. Account Terms

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials.

You must be at least 18 years old to create a creator account.
One person or entity per account. Shared accounts are not permitted.
You are responsible for all activity that occurs under your account.
Notify us immediately of any unauthorized use of your account.

3. Creator Responsibilities

Creators who sell products through the Platform agree to the following:

You are solely responsible for the products and content you list.
Product descriptions must be accurate and not misleading.
You must fulfill all orders in a timely manner as described in your listings.
You are responsible for handling customer support for your products.
You must comply with all applicable laws and regulations, including tax obligations.
You must maintain an active Stripe Connect account in good standing for receiving payments.

4. Buyer Rights

Buyers who purchase products through the Platform or embedded widgets are entitled to:

Accurate product descriptions and pricing at the time of purchase.
Secure payment processing through Stripe.
The ability to contact the creator regarding order issues.
A minimum 14-day return window from the date of delivery (see Section 4a).

souldust.xyz facilitates transactions but is not a party to the sale between creators and buyers. Disputes regarding products should be directed to the creator first.

4a. Refund & Return Policy

All products sold through souldust.xyz are subject to the following minimum return policy:

14-day return window: Buyers may request a return or refund within 14 days of delivery for any reason. This is the platform minimum and complies with EU Consumer Rights Directive and Thai Consumer Protection Act requirements.
Creator extensions: Creators may offer longer return windows (e.g., 30 days, 60 days) but may not reduce the window below 14 days.
Condition: Returned items must be in their original condition, unused, and in original packaging where applicable.
Custom & digital products: Custom-made or personalized products and digital downloads may be exempt from the return policy, provided the buyer was clearly informed before purchase.
Refund processing: Approved refunds are processed within 10 business days via the original payment method through Stripe.
Return shipping: Unless the return is due to a defect or error by the creator, the buyer is responsible for return shipping costs.

Creators who fail to honor the platform minimum return policy may have their accounts suspended.

4b. Customer Data Retention

Customer details for fulfilled orders are retained on the platform for 30 days after fulfillment. After this period, customer names, phone numbers, and shipping addresses are automatically redacted from souldust.xyz. Customer email addresses remain accessible on souldust indefinitely for order history and customer list features.

Detailed customer information — including full shipping addresses and phone numbers — remains available through your Stripe dashboard for the full 7-year tax retention period. Creators can also view redacted customer details on individual order pages by loading them from Stripe on demand.

5. Payment Processing & Agency

souldust.xyz is operated by CodeCoded Ltd (company number 11558140), a company registered in England and Wales. All payments are processed through Stripe Connect. By using the Platform as a creator, you agree to Stripe's Connected Account Agreement.

Payments from buyers go directly to the creator's connected Stripe account.
CodeCoded Ltd (trading as souldust.xyz) does not hold, control, or manage funds on behalf of creators or buyers at any time.
All prices are displayed in the currency configured by the creator.
Platform fees, if any, are deducted at the time of transaction as disclosed in your dashboard.

Payment collection agency: Each creator hereby appoints CodeCoded Ltd (trading as souldust.xyz) as its limited agent solely for the purpose of accepting payments from buyers on the creator's behalf. When a buyer submits payment through the Platform, the buyer's payment obligation to the creator is satisfied at the moment the payment is received by Stripe on behalf of CodeCoded Ltd, regardless of whether the funds have been settled to the creator's Stripe account. This agency is limited exclusively to payment acceptance and does not extend to any other aspect of the transaction between creator and buyer.

6. Intellectual Property

Creators retain full ownership of the content and products they upload to the Platform. By uploading content, you grant souldust.xyz a limited, non-exclusive license to display and distribute your content solely for the purpose of operating the Platform, including embedded widgets and hosted storefronts.

The souldust.xyz name, logo, and Platform design are the property of souldust. You may not use our branding without prior written permission.

7. Prohibited Content

You may not use the Platform to sell or distribute:

Content that infringes on the intellectual property rights of others.
Illegal goods, services, or content.
Malware, viruses, or harmful code.
Content that promotes violence, harassment, or discrimination.
Fraudulent or deceptive products or schemes.
Content that violates Stripe's Restricted Businesses list.

We reserve the right to remove any content and suspend or terminate accounts that violate these terms without prior notice.

8. Embeddable Widgets

Creators may embed souldust widgets on third-party websites using the provided script tag. Embedded widgets operate within a Shadow DOM and load assets from souldust.xyz. You are responsible for ensuring the use of widgets complies with the terms of the host site. souldust.xyz is not responsible for the content or behavior of third-party websites hosting embedded widgets.

9. Limitation of Liability

To the maximum extent permitted by law:

The Platform is provided "as is" and "as available" without warranties of any kind.
souldust.xyz is not liable for any indirect, incidental, special, or consequential damages.
Our total liability for any claim arising from your use of the Platform shall not exceed the amount you paid to souldust.xyz in the 12 months preceding the claim.
We are not responsible for losses resulting from Stripe's services, downtime, or payment processing issues.

10. Termination

Either party may terminate this agreement at any time:

You may delete your account at any time from your dashboard settings.
We may suspend or terminate your account for violations of these terms.
Upon termination, your right to use the Platform ceases immediately.
Embedded widgets will stop functioning upon account termination.
Obligations related to outstanding orders survive termination.

11. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. CodeCoded Ltd is a company registered in England and Wales. Any disputes arising from these terms or the Platform shall be resolved through binding arbitration, except where prohibited by law.
